The Tolyatti Prosecutor's Office is requesting to increase the prison terms to ten years for four defendants in the “Baymak case”

The Prosecutor's Office of the Avtozavodsky District of Tolyatti demanded to increase the prison terms for the defendants in the “Baymak case” Fidan Ismagilov, Aytugan Kitikov, Shafkat Ulmasbaev, and Rayan Fattakhov, reported the human rights project “OVD-Info”*.

“The punishment assigned to the defendants is lenient, not corresponding to the degree of public danger of the act,” quotes “Idel.Realities”** the appeal complaint of the prosecutor's office.

On March 27, the Avtozavodsky District Court of Tolyatti found them guilty of participating in “mass riots” and “using violence not dangerous to life and health against a representative of authority.” Ismagilov was sentenced to six years in a general regime colony, Kitikov to seven years, Ulmasbaev to seven and a half years, Fattakhov to five and a half years in a colony.

The state prosecution in the court of first instance requested seven years of imprisonment for Kitikov, Ulmasbaev, and Fattakhov, and seven and a half for Ismagilov.

According to the prosecutor, the court “did not fully take into account the circumstances of the crimes committed by the defendants, that is, <...> mass riots occurred, accompanied by violence, pogroms, the use of objects representing danger to others, in which the defendants participated.” The prosecutor's office also noted that “the court clearly overestimated the significance of the positive data on the personality of each of the defendants.” As a result, the agency demanded to sentence each of the convicted to ten years of imprisonment in a general regime colony.

As indicated in the case card on the court's website, the sentence was appealed not only by the prosecutor's office but also by the convicts and their defenders.

On January 17, 2024, the court sentenced activist Fail Alsynov*** to four years in a general regime colony on charges of “inciting hatred or enmity.” The criminal case was initiated at the request of the head of Bashkortostan, Radiy Khabirov. Residents of the republic gathered at the announcement of the verdict in Baymak, and the police reported “mass riots.” The Investigative Committee stated that police officers were injured, so the case included an article on “using violence against representatives of authority.”

About 80 people became defendants in these cases.
